Salerno – This is a new development in the investigation by the Salerno Public Prosecutor's Office into alleged irregular relationships between private healthcare providers and professionals with exclusive contracts with the public healthcare system. Last night, officers from the Salerno Provincial Command of the Guardia di Finanza executed a precautionary order issued by the Salerno Court, Review Section, at the request of the Public Prosecutor's Office.

The addressee of the measure is Massimo Cobellis, legal representative of the private clinic of the same name, affiliated with the National Health Service. He has been temporarily banned from holding managerial positions in legal entities and businesses for a period of one year.

The decision of the Court of Appeal

The measure represents the outcome of a new examination of the circumstantial evidence gathered by investigators from the Vallo della Lucania Financial Police Company. The Court of Review was asked to reevaluate the investigation's findings following an appeal filed by the Salerno Public Prosecutor's Office.

According to the investigators' reconstruction and the findings of the preliminary investigations judge, Cobellis appears to be facing serious charges of criminal conspiracy to defraud a public body and forgery of a public document.

The investigation involves a conspiracy that, according to the prosecution, consisted of four people and operated through a system that allowed a doctor employed by a public healthcare facility, bound by an exclusive contract, to simultaneously perform surgical activities within the private clinic.

The doctor bound by exclusivity

This is precisely the crux of the investigation. According to the prosecution's reconstruction, the professional performed surgical procedures in the private facility despite having an exclusive contract with a public health agency.

The complaint also revolves around the alleged continuation of the indemnity linked to the exclusive relationship. The doctor, despite working at the private clinic, continued to receive the related supplementary monthly indemnity from his healthcare provider, thus misleading the public body regarding his true professional status, according to the prosecution.

At the same time, according to the investigative approach, the clinic could have benefited from the doctor's professionalism and the related patient population.

The role contested against Cobellis, as administrator of the facility, would therefore be that of having allowed the professional to perform surgical procedures in the private clinic, despite having a formal exclusive relationship with the public health service.

The first precautionary measures in March

The order executed yesterday is part of an investigation that had already led to a previous development in the precautionary sphere.

Last March, in fact, personal measures were taken against two doctors working at the clinic. Investigations conducted by the financial police of the Compagnia di Vallo della Lucania had uncovered, according to the prosecution, the position of one of the professionals subject to the measure, who had performed surgical procedures at the private facility despite being an employee, with exclusive rights, of a public hospital.

The new provision now focuses on the management of the private facility in which those services were supposedly performed.

Clinic administrator under investigation

The measure notified to Cobellis, who is also related to a prominent regional councilor from Salerno, therefore takes on a specific significance within the investigation. It is not, in fact, a new measure against the doctor already at the center of the disputes, but rather a precautionary measure against the legal representative of the company that manages the clinic.

According to investigators, his position is linked to his alleged participation in the mechanism through which the doctor, despite being subject to an exclusivity agreement with the public health system, continued to work in the private facility.

The Court of Review, reassessing the evidence gathered by the Prosecutor's Office, therefore deemed that the conditions existed for applying a twelve-month ban on the administrator from holding managerial positions.

An investigation still in the preliminary phase

The picture painted by investigators, however, remains that of a charge filed during the preliminary investigation phase. The evidence acquired by the Guardia di Finanza and used as the basis for the precautionary measure will need to be subjected to further investigations required by the proceedings and scrutinized by the judges in subsequent procedural phases.
All suspects remain presumed innocent until a final sentence is reached.
The case therefore focuses on the boundary between the work performed in public healthcare and that performed in accredited private facilities: according to the prosecution, that boundary was crossed by employing a professional in the clinic who, due to his exclusive relationship with a public healthcare company, could not have performed those services outside.
