This morning, the Carabinieri Investigative Unit of Caserta executed the order for the application of the precautionary measure of house arrest, issued by the GIP of the Court of Santa Maria Capua Vetere, against Schiavone Vincenzo (de facto administrator of the “Casa di Cura Pineta Grande” health facility , located in Castel Volturno and dominus of the management direction regarding the expansion works of the same), the precautionary measure of the ban on residence in the Campania Region against Romano Domenico (technician for part of the health facility) and the interdiction measure of suspension from the exercise of public offices for one year, against Schiavone Giuseppe (Official of the Superintendency of Archaeology, Fine Arts and Landscape of Caserta). This is a continuation of the investigation for which the investigating judge had already issued a precautionary order on January 7, 2019 (and confirmed by the Court of Review). This order encompassed a variety of illegal activities involving Surveyor Carmine Noviello in his role as head of the Castel Volturno Municipal Technical Office. This order had revealed the existence of a system of collusion and connivance between the public sector, represented by Noviello, and the private sector, represented by private technicians and entrepreneurs with significant economic interests in the Castel Volturno area. One of these, Vincenzo Schiavone, was one of them. Similarly and in the same line of investigation, on September 16, 2019, the investigating judge of the Court of Santa Maria Capua Vetere issued a precautionary seizure order (also confirmed by the Royal Review Court) regarding the expansion works currently underway at the Pineta Grande healthcare facility in Castel Volturno (which operates in the Province of Caserta under institutional accreditation). These works were subject to administrative authorization with resolutions of the Castel Volturno Municipal Council nos. 30/2014 and 12/2015, as well as building permits nos. 40/2017 and 83/2018 issued by the same UTC. The investigations were initiated in February/March 2018, following a request for access by another healthcare facility operating in the Province of Caserta to the documents of the administrative procedure concluded with the issuance by the UTC of Castel Volturno of P. di C. 40/2017, accepted by the TAR Campania, in cm st which highlighted some irregularities in relation to the issuance of this building/urban planning permit.
The complex evidentiary and investigative findings have revealed that the expansion of the Casa di Cura Pineta Grande, currently under construction, authorised by resolutions of the City Council and subsequent building permits, was in clear violation of the regulations regarding the construction or expansion of healthcare facilities, pursuant to Legislative Decree 229/99 and of the regional regulation pursuant to Resolution of the Campania Regional Council no. 730 l/O l as well as of the building/urban planning regulations. First the GIP and then the Review Court have validated the illegitimacy contested by this Office, of the authorisation documents for the expansion and of the presupposed and consequent documents, also used as the basis for the order executed today, whose provisional charges concern respectively:
a) the charges of abuse of office and forgery of public documents, committed by Romano Domenico and Schiavone Giuseppe, in relation to the management of the regularization procedure pursuant to art. 36 of Presidential Decree 380/01, relating to some premises owned by the “Pineta Grande” Clinic in Castel Volturno;
b) the hypotheses of corruption, forgery of public documents, disclosure of official secrets and abuse of office against Schiavone Vincenzo, Romano Domenico and Noviello Carmine (a person for whom proceedings have already been taken), with investigative findings that have revealed how the UTC of Castel Volturno, in the person of its Manager, already arrested in January 2019, placed itself at the complete disposal of the business needs of Pineta Grande, in the context of illicit dynamics, to allow it to overcome the problems related to the impossibility of acquiring the verification of compatibility of the entire expansion project, with the regional health needs pursuant to art. 8 ter of Legislative Decree 229/99, allowing the replacement of the project tables, with modification and transformation of the hospital beds, into companion/guesthouse beds (in the year 2016 and in the month of June 20, the modified projects presented more companion/guesthouse beds than hospital/healthcare beds).
In this way, to overcome the problems inherent in the justification from the point of view of the need, arriving in 2018 to adopt also acts not falling within the competence of his office but of the Health office. The Head of the UTC also attributed to the P. di C. 83/2018 the value of authorization for the construction of the expansion pursuant to art. 8 ter of Legislative Decree 229/99. This act was conceived in its contents by the owners of Pineta Grande and its technical staff, indeed, materially drafted by Pineta Grande and received by the Head of the UTC. Furthermore, in the period following the adoption of these resolutions, hirings at Pineta Grande of relatives of the aforementioned municipal official emerged.
c) the allegations of falsity in public documents and abuse of office against Schiavone Vincenzo, Romano Domenico and Schiavone Giuseppe, also with reference to landscape aspects, where illicit dynamics emerged between the technical staff of Pineta Grande and the Official of the Superintendency indicated above. The investigation carried out for the landscape opinions under the jurisdiction of the Superintendency, the body responsible for protecting the restriction imposed on the area where the expansion project falls, was found to be completely lacking, as emerged from the consultancy and the declarations made by qualified witnesses. The landscape reports were found to be incomplete, lacking suitable photos to allow, through simulation, to evaluate and appreciate the impact of the same work on the protected context. The investigating judge, in the reasons for the precautionary order, underlined how Vincenzo Schiavone was able to create a series of relationships that allowed him to access various institutional levels to obtain benefits and to satisfy his own entrepreneurial interests and is a person capable of subjecting local public offices to his personal needs. Symptomatic of his aptitude to tamper with evidence was, moreover, the attempt to approach the investigating body in charge of the investigations, once he became aware, through the provisions already issued, of the pending proceedings against him.
