SCafati. Child abuse: Father wins sole custody of children. A sad story of psychological and physical abuse involving three minors, entrusted to their father after nearly three years of complaints and legal battles, prompted the Nocera Inferiore Voluntary Jurisdiction Court to issue a sole custody order for the children (two boys and a girl) in recent months.
The legal battle began in 2022 when the man, assisted in the divorce proceedings by the lawyer Valentina Giordano, concerned about the 'sick' relationship between his ex and their children, filed an introductory petition for custody of the children.
During the separation process, serious issues emerged regarding the woman's relationship with the children, which escalated into physical and psychological abuse, including beatings and insults. The support efforts of the Scafati Social Services, coordinated by Dr. Maria Chicherchia, revealed details of a mother-child relationship that was concerning for the children's stability.
Last December, the judge – based on reports from social services – issued a provisional order establishing the placement of the minors in their father's home with visitation rights for their mother.
But the situation hasn't improved at all. Quite the opposite. At every meeting with the woman, the children seemed destabilized and shaken, so lawyer Valentina Giordano requested a suspension of the children's visits with their mother. And the Court, pending a final decision, partially granted the request, ordering supervised visitation.
According to what emerged during the trial, all decisions regarding the children's lives and primary needs were opposed by the woman, so much so that in June the court awarded the children to their father exclusively pending the final conclusion of the trial.
Alongside the civil case, the woman faced a criminal trial for domestic abuse. Last May, the investigating judge issued a precautionary order prohibiting her from approaching her children, requiring her to wear an electronic bracelet.
According to what emerged during the investigations, the mother had repeatedly subjected the children to violent and harassing behavior within the home, in a family context considered by investigators to be seriously compromised.
The precautionary measure necessary to protect the minors and ensure their safety and peace of mind resulted in a plea bargain of one year and four months of imprisonment, with a suspended sentence, handed down by the judge to the 4-year-old.
The woman, assisted by lawyer Sofia Pisani, allegedly subjected her children to a series of physical and verbal abuses. The children themselves described what happened when they were with their mother, to the extent that they lived in a state of fear and awe.
As the father's lawyer, Valentina Giordano, had 'denounced' in her appeal to the Court, the children were subjected to verbal abuse and insults that on several occasions resulted in beatings and slaps.
The woman, unable to manage her relationship with her children, even beat them with a broomstick. This unbearable situation for the children led the Voluntary Jurisdiction Court to place the children in custody with their father, and the criminal judge to plea bargain the woman for domestic abuse to protect the children's peace and safety.

It's truly sad that these children were placed with their father, after all the terrible things they've been through. I hope the court makes the right decisions for their safety and well-being, because no child deserves to go through this.
