Naples, the Regional Administrative Court (TAR) overturns the 'red zones': "The Prefect's order is illegitimate."

A ruling destined to make a stir is the one with which the Regional Administrative Court of Campania annulled the order of the Prefect of Naples that extended the ban on loitering in the so-called "red zones" of the city, measures imposed under pressure from a directive from the Minister of the Interior Matteo Crying himselfAccording to the administrative judges, the provision lacked the necessary prerequisites, therefore it was illegitimate and, above all, harmful to the fundamental principles of the rule of law.

According to the ruling, there was no exceptional emergency justifying the prefect's repeated recourse to extraordinary powers. No new motivation, no real urgency. Just a distorted use of the concept of emergency, which for months imposed extraordinary restrictions as if they were the norm.

“It is a victory for the rule of law” stated the lawyers Andrea Chiappetta and Stella Arena, legal representatives of the appellant associations. "The TAR has ruled that the exception cannot be transformed into the rule. The Constitution cannot be suspended for political convenience." They were joined by municipal councilors Chiara Capretti and Pino De Stasio, among the promoters of the appeal. "This is a resounding rebuke for those who used the state of emergency as an excuse to silence democratic debate. The TAR restores the rule of law and visibility to the territories."

  • I don't fully understand the implications of this ruling; it seems to me there's a lot of confusion. The red zones were established for a reason, but now everything is changing without a clear reason. Let's hope things get clearer.
