SThe trial against Nicola R., 50 years old, originally from Benevento but resident in Giugliano in Campania for some time, accused of aggravated receiving and money laundering, ended with a full acquittal.
The decision was made by the Court of Naples, in collegiate composition (III Panel B, president Primavera), which established that the defendant "did not commit the crime", fully accepting the defense's argument.
The procedure arose from an investigation conducted by the Police Station of Giugliano, taken following a GPS signal sent by a Mercedes rented by the company EuropeCar, based in Nice, France.
During a search, law enforcement officers found a Mercedes, an engine, a propeller, and numerous dismantled and packaged car parts at Nicola R.'s home, believed to be of illicit origin, with an estimated total value of €150.000.
The Prosecutor's Office had claimed that the 50-year-old possessed the material in conjunction with his brother, who died in December 2022 (whose case was subsequently dismissed and declared extinguished), and had requested a five-year prison sentence.
The defense, led by attorney Massimo Viscusi, demonstrated the defendant's innocence regarding the alleged facts, emphasizing the lack of objective evidence directly linking Nicola R. to the criminal network. A long and detailed argument convinced the judges to fully acquit the man.
The sentence, pronounced after the court hearing, represents a clear victory for the defense and closes a case that, initially, seemed likely to result in a heavy sentence.
