Naples: Judge cancels €30 fine for 2018 fines

Naples – Two years ago, FA, a 70-year-old retiree, received a tax bill from the Revenue Agency (Agenzia delle Entrate-Riscossione) for more than €30.000. The amount concerned traffic fines issued by the Prefecture in 2018. Without opposition, the claim would have become final and could have opened the door to foreclosures and mortgages.

The appeal was filed by attorney Cristiano Ceriello, legal director of Consumer and Taxpayer Defense. The main reasons: lack of proof of notification of the documents prior to the tax bill and the statute of limitations on the debt.

"All null and void": the 2026 decision

After approximately three years, in 2026, proceedings RG 47760/2023 were concluded before the Justice of the Peace of Naples. The outcome was clear: the tax bill was annulled. According to the judge, there was no evidence of notification or interruption of the statute of limitations. FA no longer owes anything. The agency and the concessionaire were also ordered to pay litigation costs, amounting to nearly €2.000.

Notifications must be proven, the file is not a conviction

"Receiving a notice doesn't mean receiving a conviction," Ceriello observes. The dealer and the entity must demonstrate proper service of preliminary documents, the absence of a statute of limitations, and the legitimacy of the sums claimed. If they fail to do so, the claim is dismissed. The principle is the same one the association has long reiterated regarding traffic fines: the notice alone does not cure previous violations. Without proof of the chain of documents, the claim will not stand up to trial.

Thirty days to move

Pasquale Di Carluccio, president of the Consumer and Taxpayer Defense Association, emphasizes timeliness. Oppositions have short deadlines. For traffic fines, in many cases, the deadline is 30 days from notification. Once that deadline has passed, the fine can become final. "As in the FA case, after 30 days the fine would have become final. Acting promptly can save your wallet," Di Carluccio emphasizes. The association's message is practical rather than polemical: immediately check the notification date, amounts, years of violations, and documentation of previous notifications. Then, if there are any flaws, appeal before the deadline expires.
