The Supreme Court of Cassation has definitively ruled that Alessandro Farina's death was a crime, but the family has yet to receive compensation from the San Giovanni di Dio and Ruggi d'Aragona Hospital in Salerno. After years of legal battles, the boy's mother, Tiziana Morra, has announced a new civil action seeking damages.
Alessandro was 13 years old when he died in 2017, following a late diagnosis of type 1 diabetes mellitus and errors in subsequent treatment, according to the court proceedings.
"The Supreme Court has definitively established liability for the death of my son Alessandro, but the Ruggi hospital in Salerno has still not awarded any compensation. After years of legal battles, we are forced to return to court," his mother complains.
According to the woman, the Supreme Court's ruling, issued on April 30, definitively established the liability of the two accused health workers and the civil liability of the hospital. Attempts to reach an agreement, including through mediation, have, however, been unsuccessful.
Hence the decision of the family, assisted by lawyer Federico Conte, to file a new civil lawsuit for damages.
"There's no amount of money that can repay Alessandro, but it's unfair to force a family, after three levels of judgment, to face another ordeal," says Morra, who also requests the intervention of the President of the Campania Region, Roberto Fico.
The appeal is aimed at clarifying the reasons for the failure to reach an agreement with the hospital and at shedding light on any measures adopted against the health workers involved in the affair.
"I also want to know what measures have been taken against the health workers involved. I've submitted a request for access to the documents, but I haven't received a response yet," she adds.
Alessandro's mother demands the right to clear answers, in addition to the recognition of the responsibilities already established in court. "Alessandro is not a case number; he was my son. I'm not seeking revenge; I'm asking for justice, transparency, and respect for a family that has already paid the highest price," she concludes.
