Naples: The Supreme Court overturns Crescenzo Marino's acquittal, prompting a new trial.

Naples – The "Case Celesti" complex on Via Limitone di Arzano is much more than an urban agglomeration: it is a strategic hub for Neapolitan organized crime. It is here, according to the prosecution's line of reasoning, that the power dynamics at issue in the ruling of the Fifth Criminal Section of the Supreme Court of Cassation on May 19th played out (President: Maria Teresa Belmonte, rapporteur: Pierangelo Cirillo).

The protagonist of the story is Crescenzo Marino, son of the boss Gennaro Marino 'o McKay, a figure whose profile has, over the years, acquired a transversal media visibility, a framing, that of the character, which on the one hand fuels his fame, on the other does not undermine the neutrality of the judicial rigor necessary to analyze his criminal conduct.

The Supreme Court of Cassation drew a clear line, overturning the second-instance ruling that, in October 2025, had acquitted Marino (represented by lawyers Saverio Senese and Dario Vannetiello) of the charge of being the promoter and director of the Marino clan. According to the Supreme Court, the Naples Court of Appeals conducted an "atomistic" analysis of the evidence, fragmenting a mosaic that, if reassembled, would offer a very different picture of the accused's leadership between 2015 and 2016.

The word to the repentants: the role of leadership

One of the cornerstones of the Supreme Court's decision concerns the evidentiary value of the statements of the collaborators of justice, particularly those of Salvatore Roselli and Pasquale Cristiano. The Supreme Court of Cassation found a serious "misrepresentation by omission": the Court of Appeal had dismissed as "generic" or "out of context" certain depositions that, in fact, placed Marino in a position of command during the disputed period.

The testimony of Roselli, a leading member of the Amato-Pagano clan, is emblematic. He explicitly stated that, after the arrest of clan leader Roberto Manganiello in April 2016, control of the "Case Celesti"—including the dynamics of drug trafficking—had passed into the hands of Crescenzo Marino.

A statement which, according to the Court of Cassation, cannot be dismissed as a simple inference, given the leading position occupied by the proponent.

The fugitive's "missive" and the accounts that don't add up

In addition to the statements of the informants, the reopening of the case is influenced by the analysis of a manuscript found in Roberto Manganiello's hideout at the time of his arrest. The document, which details illicit dealings and cash shortages, mentioned the need to account for a sum of €10.000 to "Cresc" (Crescenzo Marino) and his mother.

While the appeal judges had attempted to interpret this transition as a dynamic linked to forms of family or ancestral respect, the Supreme Court of Cassation rejected this reconstruction, defining it as "devoid of logical support".

For the Supreme Court, the need to report to the defendant and his mother, in the context of a communication intended for a fugitive mafia boss, is tangible evidence of a coordinating role and operational hierarchy that the defense will now have to address in a new trial.

The new judgment

The case now returns to another section of the Naples Court of Appeal. The judges' task will be to evaluate the entire body of evidence—the wiretaps, the manuscripts, and the statements of the informants—no longer as isolated events, but as parts of a unified whole.

For Crescenzo Marino, whose name continues to spark interest in family and territorial dynamics, a new judicial phase is thus opening, one that promises to clarify, once and for all, the boundaries of his role within the criminal hierarchy of Secondigliano.

The proceedings thus resume. The new judging panel will necessarily have to address the critical findings of the Supreme Court: it will no longer be possible to dismiss the circumstantial evidence as "marginal details." Justice is called upon to reinterpret, in a unified light, the role of Crescenzo Marino, in a trial that promises to redefine the influence of the highest levels of the Secondigliano hierarchy during the years of the post-fugitive Manganiello transition.
