Prato – The criminal charge formulated by the judiciary is extremely serious: attempted murder under Article 56 of the Criminal Code. This is the charge brought against a Penitentiary Police officer from Airola in the province of Benevento, represented by the lawyer Vittorio Fujcci, who intervened on August 16th at the Prato emergency room to stop a dangerous inmate who was on the run.

A legal and media case that immediately sparked a reaction from Si.NAPPe (National Autonomous Union of Penitentiary Police), resulting in a harsh letter addressed to the heads of the State and the Justice system.

The reconstruction of the facts and the accusation of the Prosecutor's Office

According to the statement released by the union's General Secretariat, the officer intervened during a highly tense situation within the healthcare facility. The inmate, after posing a serious and concrete risk to the safety of those present, attempted to escape.

The uniformed officer then allegedly fired warning shots into the air, then aimed at the fugitive's legs. The prosecutor's office has charged this as attempted murder, arguing that the officer unequivocally committed acts aimed at taking the prisoner's life.

The "operational dilemma" of the policeman on duty

In a statement signed by Secretary General Roberto Santini, Si.NAPPe clarifies that it does not intend to replace judges or advocate for "criminal shields" or free zones exempt from legality controls. However, the union emphasizes the psychological and operational repercussions such a protest could have on the entire Corps.

"What decision will the next prison officer face when confronted with a violent inmate?" the union asks. The feared risk is that of paralyzing law enforcement, faced with a dramatic choice: "Act, risking being investigated for attempted murder, or do nothing, risking being held accountable for what he failed to prevent?"

The devastating effect of the "media trial" is also denounced, a true "scarlet letter" that will be difficult to erase even in the event of a future and possible acquittal.

Applause for the undersecretaries and a dig at Meloni and Nordio

Finally, the union document takes on a marked political dimension. While Si.NAPPe expresses appreciation for the support shown by Justice Undersecretaries Andrea Ostellari and Alberto Balboni, it also takes a swipe at the top of the Executive.

The union bitterly notes "the silence of the Prime Minister's Office and Justice Minister Carlo Nordio." According to the prison guards, those who lead the State Administration would have been expected to show public support and urgently commit to introducing rules of engagement and legal protections appropriate to the specific nature of their role, so that fulfilling their duties does not result in disproportionate legal risk.
