Naples – No professional liability has emerged against the head physician Felice Pirozzi and the healthcare staff who treated Antonia Francesca Tucci, the 24-year-old who died on July 3 in intensive care following surgery performed in the hospital.
This is what Gabriele Di Criscio, attorney for the director of General Surgery at the Cardarelli Hospital in Naples, claims based on the autopsy report filed on October 5th as part of the legal proceedings.
Pirozzi is under investigation, along with two other doctors on his team, for the young woman's death. The consultants' assessment, according to the defense attorney, did not identify any questionable conduct in the patient's clinical management, from the pre-surgery phase to the interventions required after a complication arose.
In the statement released by the lawyer, the report is described as favorable to the position of the chief physician and the other healthcare professionals involved. The consultants, in fact, deemed the preoperative management, the surgical indication, and the procedure to be correct.
An assessment which, according to the reconstruction provided by the defense, does not highlight errors in the clinical choices made before the operation or in the execution of the surgical procedure.
The consultants also deemed the postoperative management of the complication that necessitated a second operation to be adequate. In this case, too, reports attorney Di Criscio, the consultants acknowledged the timeliness and correctness of the subsequent operation.
In the defense's reconstruction, no omissions or critical issues were found that would establish professional liability on the part of the doctors who treated the 24-year-old.
The key point of the assessment, as explained by the lawyer, concerns the absence of any negligence in the healthcare workers' conduct. "The healthcare workers' conduct," Di Criscio emphasized, "is deemed diligent, expert, and prudent."
According to the lawyer, the complications that led to the death were not attributable to the doctors' conduct and were addressed in accordance with good clinical and healthcare practices.
The report, according to the defense statement, therefore does not identify any diagnostic or therapeutic errors, nor any omissions attributable to the healthcare personnel.
The investigation, however, remains the judicial stage through which the circumstances of the young woman's death must be ascertained. The conclusions cited by the lawyer represent the assessment of the autopsy report as reported by the defense and do not, in themselves, amount to a definitive decision by the judicial authorities regarding the suspects' positions.
