When the prosecutor Santoriello wrote: “Incorrect Juve guilty of Calciopoli”

"It is completely incorrect to maintain that in the criminal proceedings" in the Calciopoli trials, " Juventus ' civil liability for the sporting fraud committed by its directors has already been established in an undisputed and definitive manner." This is what Ciro Santoriello wrote.

Santoriello and the request to archive the investigation against Agnelli

The Turin prosecutor 's office is currently at the center of a controversy over a video in which he proclaims himself a Napoli fan , in a request to shelve an investigation ( initiated in 2017) against Andrea Agnelli and four other suspects.

The video is taken from a 2019 conference of lawyers, where the magistrate explained the terms of the proceedings. The investigation was launched following a complaint from a Bologna club.

The initial theory was that Juventus , in light of the legal proceedings in Rome and Naples , should have entered certain sums in its balance sheet, under a specific heading, to cover any compensation. Prosecutor Santoriello, after a lengthy examination of the legislation, concluded that this was not necessary.

The only development there had been, in fact, was a 2015 ruling by which the Supreme Court of Cassation reinstated Juventus as "civilly liable." This, however, didn't mean it had already been convicted.

"It's incorrect to call Juventus guilty of Calciopoli."

"What has been established in the civil proceedings ," Santoriello wrote , " is simply that the football clubs participating in the Serie A championship (and therefore also the shareholders of those clubs, including the plaintiff) have, in theory, full legal standing to sue the Turin sports club for damages."

“The ruling made in the second instance in the proceedings (one of those on Calciopoli, ed.) that had led to the exclusion, among the civil parties, of the football clubs participating in the championship was erroneous, arguing that no legitimatio ad causam could be established on their part”.
