The abbreviated trial was discussed today before the GUP of Torre Annunziata, Dr. Crasta, against Arturo Martinelli, 44 years old, alias “Scarface”.
The well-known criminal is accused of mistreatment in the family, with the aggravating circumstance of having committed them in front of minors; of aggravated and multiple acts of stalking; of aggravated injuries, continuously, in relation to the special aggravating circumstances.
He was sentenced to 2 years and 4 months of imprisonment, taking into account the reduction in sentence provided for the choice of the abbreviated procedure. The PM had requested 4 years of imprisonment.
This is the outcome of today's discussions, of the long prosecution's closing argument, of the argument of the injured party and of the lengthy speech of the defendant's defense, represented by the lawyer Massimo Viscusi, a criminal lawyer from the Benevento Bar Association.
Martinelli, alias Scarface, through his previous lawyer, had requested a plea bargain, which was rejected by the first investigating judge/judge, for which reason he had then requested and obtained the definition of the trial according to the abbreviated trial procedures, requested and obtained by his new lawyer.
From house arrest with an electronic bracelet, which he had been placed under on November 7, the precautionary measure of house arrest was revoked with the more afflictive measure of imprisonment in Poggioreale prison, on April 22, 2024, the date on which he had appointed a new lawyer.
The investigation, which arose from the so-called “Red Code” and was conducted by the Carabinieri of Torre Annunziata, was meticulous and thorough, and even brought to the attention of the judge a complaint filed by the victim in October 2012.
