The trial for the wounding of Luca Di Stefano, a well-known restaurateur and TikTok content creator, owner of the fish and seafood restaurant "O' sole e notte 2," ended with sentences lower than the prosecution's initial request. The judge ruled out the aggravating circumstance of premeditation for all the defendants, upgrading the charge from attempted murder to personal injury.
Michele Orefice, considered by investigators to be a prominent figure in local organized crime (northern Naples), was sentenced to four years in prison. The perpetrators received slightly longer sentences: five years and eight months for his twenty-year-old son, Luigi Orefice, and five years and six months for his twenty-three-year-old accomplice, Pietro D'Angelo.
The downgrading of the crime was determined by a wiretap obtained during investigations conducted by the Naples Flying Squad and the Frattamaggiore police station. A specific phrase, captured by investigators' microphones—"Shoot in the legs... and you're gone..."—convinced the Court of Appeal that the intent was not to kill, but to injure the victim.
Again through wiretaps, it was possible to reconstruct the motive for the attack. A conversation on May 15, 2025, between Michele Orefice, already in prison at the time, and a woman with a past relationship with him revealed that the incident stemmed from a personal and passionate retaliation, linked to an alleged relationship between the latter and the restaurateur.
The events date back to the evening of May 13, 2025. According to investigators' reconstruction, Pietro D'Angelo, acting with his face covered, entered the fish and seafood restaurant. Pointing the gun at the kitchen area, he fired two shots, hitting Di Stefano in the hand.
The victim's quick reaction, using the restaurant's tables to defend herself and unbalance her attacker, prevented worse consequences. The perpetrator's escape was then accelerated by the chance passage of a police car with sirens blaring, putting an end to an episode in which criminal dynamics were intertwined with private matters.
