Capodimonte: The Regional Administrative Court (TAR) suspends the tender for surveillance of the park and forest.

The Campania Regional Administrative Court (TAR) has suspended the tender process launched by the Capodimonte Museum and Royal Woods for the contract to provide unarmed daytime security services within the Park and Woods.

The decision came after an appeal was filed by Sistemi Srl Servizi Fiduciari, a company based in Macerata, which challenged the recalculation of the technical score made by the contracting authority after the opening of the financial bids. The change resulted in the subtraction of five points from the company, causing it to drop from first to fourth place in the ranking.

The Fourth Section of the Regional Administrative Court, presided over by Paolo Severini, granted the request for interim measures and ordered the suspension of the contested decisions. According to a statement from attorneys Morena Luchetti and Pier Paolo Persichini, who assisted the company, the panel deemed the need to ensure the legitimacy of the tender procedures to be more important than the immediate continuation of the procedure leading to the award.

This is a precautionary measure and not a final decision on the merits of the appeal. The public hearing has been scheduled for December 16, 2026, when the judges will be called upon to examine the merits of the company's claims.

In the meantime, the Capodimonte Museum could intervene independently on the procedural documents, evaluating their possible annulment through self-regulation. In the absence of administrative intervention, the Regional Administrative Court (TAR) will rule on the issues raised in the appeal.

The tender therefore remains suspended pending the next steps, while the litigation will clarify the legitimacy of the redetermination of the score, which had significantly modified the ranking.
