Medical Device Payback: "Medtech Payback" Arrives: Broya de Lucia's investigative book

ROME. Medical device payback becomes an investigative book. Titled "Medtech Payback," the book by Gennaro Broya de Lucia, president of Conflavoro PMI Sanità, was published today on Amazon, the day of the Council of State hearing on the controversial issue of healthcare spending overruns.

Through documents, figures, letters, and court decisions, the book reconstructs the origins of the mechanism and its consequences for companies in the sector, moving the topic beyond the confines of technical discussions and bureaucratic language. "I published this book," says Broya de Lucia, "to educate Italians about what happened and to explain how a healthcare spending planning problem ended up weighing on the budgets of companies that supply devices to hospitals every day."

On the very day of the hearing, the president of Conflavoro PMI Sanità once again called for immediate political intervention. "Planning can prevent the same mistakes from happening tomorrow, but it can't prevent businesses from closing today. Talking about new caps, governance, and innovation isn't enough: concrete decisions are needed."

Conflavoro PMI Sanità calls for "the suspension of payment requests, enforcement proceedings, and compensation, a definitive solution for the 2015-2018 period, with effective protection also for companies that have already paid, and the sterilization of payments for years after 2018." The association also calls for "the repeal of the payback on medical devices in the 2027 Budget Law."

"We're not asking for another roundtable discussion, and we're not asking for another promise," Broya de Lucia attacks. "We're asking for regulatory intervention, financial coverage, and a vote. First, let's make businesses safe, then let's discuss how to improve healthcare planning."

Litigation remains at the heart of institutional debate: in 2024, the Constitutional Court deemed the constitutional legitimacy questions raised regarding the payback mechanism unfounded, limited to the four-year period 2015-2018, while in 2026, the Council of State referred new questions to the Constitutional Court regarding the mandatory 0,75% contribution on turnover allocated to the Medical Devices Governance Fund.

"This isn't just an industrial dispute," concludes Broya de Lucia. "The survival of businesses, jobs, and the stability of the Italian medtech industry are at stake. The time for analysis is over. Now, policymakers must act."
