

The Court of Cassation
The legal case surrounding the Pagnozzi clan returns to the Naples Court of Appeals. This follows the Supreme Court's decision, which overturned with a referral the convictions of Paolo Pagnozzi, Andrea Salsiccia, and Vincenzo Lomasto, while ordering the annulment without referral of the convictions of Aniello De Paola, Giuseppe Maiocca (born in 1987), and Francesco Maiocca.
The appeals of the other appellants, however, were dismissed. This ruling significantly redraws the procedural framework, distinguishing the individual positions of the defendants.
Of particular note is the case of Paolo Pagnozzi, who was sentenced to 16 years and 8 months in prison in the first instance. According to the prosecution's reconstruction, the core of the charge was the alleged financing of the association, with charges under Article 416-bis of the Criminal Code and recidivism.
In the second instance, the sentence was re-determined to 13 years and 4 months, after the exclusion of two charges.
The defense then took the case to the Supreme Court. In the Supreme Court proceedings, Pagnozzi was represented by attorney Dario Vannetiello, after being defended on appeal by attorneys Mara Borreca and Marcello Severino.
The appeal was divided into eight grounds and contested various aspects of the decision of the lower court judges.
According to the prosecution's approach, part of the evidence was based on the content of several wiretaps. It was precisely through these conversations, according to the Prosecutor's Office, that the alleged role attributed to Pagnozzi within the group's dynamics emerged.
The defendant, in particular, was also accused of acting as guarantor of the organization in the Benevento area, in addition to allegedly financing the group.
However, these are disputes that must be kept separate from the final outcome of the trial: the Court of Cassation ordered the annulment of the cases of Pagnozzi, Salsiccia, and Lomasto with referral, leaving their respective positions for a new evaluation on the merits.
Therefore, for the three defendants affected by the annulment with referral, the legal battle is not over. A different section of the Naples Court of Appeal will have to reexamine their positions in light of the indications contained in the Supreme Court's decision.
The procedural fate of Aniello De Paola, Giuseppe Maiocca, and Francesco Maiocca was different: the Court of Cassation ordered their cases to be annulled without referral, resulting in their respective positions being removed from the proceedings within the timeframe established by the Supreme Court.
The Supreme Court's ruling therefore has different effects within the same proceedings. On the one hand, three positions are returned to the lower courts for reconsideration; on the other, three defendants' cases are annulled without remand. For the other appellants, however, the Supreme Court upheld the dismissal of their appeals.
The proceedings will now continue before the Court of Appeal of Naples for the positions affected by the annulment with referral. Subsequent judicial proceedings will determine the concrete effects of the Supreme Court's decision on the individual disputes.
