Naples opens an institutional forum to streamline assisted negotiation in family law.

A meeting at the Naples Courthouse brings together the judiciary, the Public Prosecutor's Office, the legal profession, and the notary public to define common practices regarding authorizations, the effectiveness of agreements, and the registration of the family home.

Naples is preparing to systematize assisted negotiation in family law. On October 15th, the Court of Naples will host a debate-meeting promoted by the Family Commission of the Naples Bar Association (COA), with the aim of making this tool increasingly effective, rapid, and decisive.

The initiative, entitled "Assisted Negotiation in Family Law: Critical, Practical, and Enforceable Aspects," aims to foster shared operational practices around three key issues: clearances and authorizations from the Public Prosecutor's Office - Civil Affairs; the conditions and timeframes for agreements to be enforceable; and the procedures for registering agreements regarding the assignment of the family home in the land registry.

The event, which will be held at 1:30 PM in the Girardi Hall of the Naples Courthouse, will bring together professionals and key figures in the justice system to address operational issues in family disputes and define streamlined procedural steps, respecting the responsibilities of the relevant offices. The goal is to facilitate consensual dispute resolution and reduce the burden on judicial offices by consistently applying the procedures established by law.

Among the topics at the center of the discussion are the timing and conditions for obtaining authorizations and permits from the Public Prosecutor's Office - Civil Affairs; the timeframe within which an agreement between the parties becomes enforceable; and the operational procedures for officially registering agreements for the assignment of the family home in the land registry. The discussion aims to clarify the requirements required by the competent offices, outline the procedural steps, and propose concrete solutions to prevent formal disputes, delays, or referrals before the President of the Court.

The roundtable will feature representatives from the judiciary, the Public Prosecutor's Office, the legal profession, and the notary profession. Speakers include Raffaele Sdino, President of the First Civil Section of the Court of Naples; Ilaria Mancusi Barone, Public Prosecutor of the Court of Naples – Civil Affairs; Linda Catagna, a magistrate of the Court of Naples, former judge of Executions in Santa Maria Capua Vetere; Roberta Cocchia, a notary public in Naples; and Ludovica Russo, a member of the Family Commission of the Naples Regional Council (COA). The introductory session will be led by Roberta Foglia Manzillo, a member of the Naples Regional Council responsible for Family Affairs, while Daniela Cozzolino, also of the Naples Regional Council (COA) will moderate. Question Time will feature contributions from Flora Antinolfi, Paola de Falco, and Annabella D'Anna, also members of the Naples Regional Council (COA). The conclusions are entrusted to the lawyer Camilla Aiello, coordinator of the Commission itself.

The initiative therefore presents itself as an opportunity for institutional updating and dialogue, aimed at promoting greater clarity of application and more efficient procedures for professionals and citizens involved in family disputes. Attendance at the event will earn 3 credits in ordinary subjects.
