

The Court of Naples
The Court of Naples, Sixth Civil Section, has set October 27, 2026, as the hearing date for the appeal filed on October 2 by lawyer Luigi Doronzo of the Carpagnano-Doronzo Law Firm in Barletta, representing the residents of the building on Via II Traversa di Via Tranvai, adjacent to the church of Santa Maria della Purificazione, known as "dell'Angelo."
The place of worship, owned by the Diocese of Pozzuoli according to municipal documents and the Superintendency, was declared damaged by the bradyseismic swarm of July 31st and has never been made safe, despite Mayoral Ordinance No. 400 of August 13, 2026, which required immediate interventions.
With that same ordinance, the Municipality ordered the evacuation of the residential building adjacent to the church: since then, the families have not returned to their homes, even though the residential building was structurally intact and uninhabitable only due to the risk posed by the religious building.
Among the residents is an 83-year-old woman who has been away from home for over two months and is staying with others.
The Superintendency's damage assessment report, drawn up on August 14, describes the church's "terrible" state of repair, "serious" pre-existing damage, and "imminent risk of collapse." The façade's portal was already propped up before the earthquake.
The Fire Brigade detected a "very pronounced and widespread" cracking pattern, with possible overturning mechanisms towards the residential area.
The Municipality, with ordinance no. 390 of the same August 13th, ordered the Diocese to take immediate action to remove the dangers.
Formally warned on August 21, the Diocese responded on September 29 through its Finance Office, declaring itself "fully aware of the situation" but "waiting to define any possible useful initiative," without indicating any timeframe or concrete commitments.
Under the heading "emergency measures carried out," the September 23rd occupancy certificate lists just one word: "none."
The appeal asks the Court to order the Diocese of Pozzuoli, owner and custodian of the building, to immediately carry out the safety measures already identified by public technicians, imposing a penalty for each day of delay.
The hearing's scheduling so soon after the filing, the lawyers emphasize, confirms the seriousness and urgency of the situation.
"We are only asking for what the public authorities have already determined to be necessary," said attorney Doronzo.
