The second degree trial relating to Operation British , which involved numerous criminals accused of drug trafficking in the Caudina Valley , particularly in Montesarchio , has concluded before the Court of Appeal of Naples .
While the Court confirmed all the convictions, the only sentence reduction was granted to Marco Iovino , who will not return to prison. The investigation, based on wiretaps and telephone conversations, video footage, drug seizures and police stakeouts, led to the arrest of 11 people . Among the main defendants are Marco Iovino, 58, known as “Marcuccio” , and the brothers Maurizio Arena (47) and Gaetano Arena (45) , all assisted by the lawyer Vittorio Fucci.
During the operation, Iovino was found in possession of 209 grams of cocaine and two pistols with removed serial numbers , which led to a second arrest in addition to the one for the precautionary warrant. He and the Arena brothers were accused of playing a leading role in drug trafficking.
Despite the seriousness of the charges and the defendants' recidivism, the preliminary hearing judge of the Benevento Court had imposed much lighter sentences than the prosecution had requested. Maurizio Arena : 8 months in prison (compared to the request for 4 years and 4 months ); Gaetano Arena : 4 years and 2 months (despite a previous conviction for voluntary homicide); Marco Iovino : 5 years and 4 months , despite his double arrest.
In the second-instance trial, the Court of Appeal confirmed the convictions of five defendants , but partially accepted the defense's requests, further reducing Iovino's sentence from 5 years and 4 months to 5 years and 3 months . Thanks to the time already spent under house arrest, Iovino and the Arena brothers will not return to prison , as their remaining sentences are less than 4 years , the threshold that allows for the suspension of the execution order.
This is another positive result for Iovino, following the revocation of his residence permit in recent months and his acquittal in the trial stemming from Operation "Parking ," conducted by the Carabinieri of Montesarchio. Despite the favorable ruling, lawyer Vittorio Fucci has announced he will appeal to the Supreme Court to obtain further sentence reductions , while reiterating that the defendants will no longer have to serve prison sentences for this proceeding.
