Domenico's case: The family issues a formal warning to Monaldi: "Urgent appeals without a meeting."

Naples – A new step has been taken by the family of Domenico Caliendo, the almost two-and-a-half-year-old boy who died on February 21st in the intensive care unit of Monaldi Hospital, after the failure of the heart transplant he underwent on December 23rd, 2025.

Attorney Francesco Petruzzi, representing the child's family, sent a letter to the hospital management as part of the out-of-court settlement negotiations. In the letter, the lawyer invites Monaldi to schedule a meeting within seven days, warning that, if he fails to do so, precautionary and urgent appeals will be filed.

The request comes after the last meeting of the Claims Assessment Committee, held on July 21st. According to the family's lawyer, the body has completed the process of quantifying the damages. That assessment, however, was not followed by any formal communication to summon the child's parents.

"To date, there is no trace" of the announced meeting, emphasizes Petruzzi, who is now requesting immediate response from the hospital to avoid recourse to the judicial authorities, including civil proceedings.

Meanwhile, the criminal proceedings into the death of little Domenico remain open. The hearing for the preliminary investigation, a technical step intended to finalize the investigation's findings and expert opinions, has been scheduled for September 11th. However, the hearing could be postponed.

A hearing is also scheduled for the same day before the Court of Review, which will rule on the injunctions ordered by preliminary investigations judge Mariano Sorrentino against the two heart surgeons who performed the transplant on the child. The family, therefore, continues to pursue both options: seeking compensation from the hospital and determining any liability in court.
