Prato – "I have faith in the judiciary's work. However, I hope that, given clear justification for my client's conduct, the new rules introduced by the Security Decree will be applied."

This is according to lawyer Vittorio Luigi Fucci, the trusted defense attorney of the Sannio prison officer serving in the Prato prison, who is involved in the investigation opened after the shooting in the emergency room and is being investigated for attempted murder.

The reference to the new legislation

The lawyer recalls the amendments made to Article 335 of the Code of Criminal Procedure by Law No. 54 of April 24, 2026, referred to as the new Security Decree.

According to the defense, the introduction of paragraph 1-bis.1 requires a preliminary annotation in Form 45-bis: a step that, in certain circumstances, can prevent the operator from being automatically registered in the register of suspects when the act performed during the service gives rise to the presumption of the existence of a justifiable cause.

"This is exactly what I believe can emerge in the case in question," Fucci claims, referring to the officer's conduct.

“Radical reform for those who work in service”

Attorney Fucci also raises the issue of safeguards for law enforcement officers involved in sensitive operational situations.

"In any case, I believe a radical reform is necessary, capable of better protecting law enforcement officers who act when there is clear justification," the lawyer concludes.

The interrogation in the next few hours

The prison officer will be questioned in the next few hours as part of the investigative process. He will be represented by lawyers Vittorio Luigi Fucci and Giuseppe Vittorio Fucci.
