Martina Carbonaro, the 14-year-old's parents will be re-examined tomorrow: the electronic bracelet is up for discussion.

The hearing is expected tomorrow, Monday, September 14, before the Naples Review Court on the order that banned Marcello Carbonaro and Fiorenza Cossentino, Martina Carbonaro's parents, from approaching the family of Alessio Tucci, the girl's ex-boyfriend accused and confessed to her murder.

This precautionary measure has added another particularly sensitive chapter to the legal proceedings stemming from the death of the 14-year-old girl from Afragola. The measure also includes the use of an electronic bracelet and stems from complaints filed by Tucci's family following a series of tense incidents, including threats, during and after the initial hearings of the trial.

Martina's parents' defense is now asking the Court of Appeal to review that decision, contesting the existence of the conditions for the measure and, above all, the reconstruction of the conduct attributed to the couple.

Tensions exploded at the beginning of the trial

The story begins with the heated climate that erupted on May 19, when the trial for Martina's murder began before the Naples Assize Court.

Tucci's entrance into the courtroom provoked a strong emotional reaction from the victim's family. Insults and threats circulated between the two families. During one of the most heated moments, the phrase "I'll cut your head off" was even heard. Law enforcement had to intervene to restore calm and remove some of the defendant's family members from the restricted area.

The Court then decided that Tucci, for reasons of security and public order, would follow the subsequent hearings from prison via videoconference.

Those tensions, however, did not remain confined to courtroom reporting. The incidents subsequently became the subject of complaints and a judicial review separate from the murder trial.

The precautionary measure for Martina's parents

Following complaints filed by Tucci's family, the North Naples Prosecutor's Office requested a measure against the victim's parents. The investigating judge therefore ordered them to be prohibited from approaching the defendant's relatives, along with the requirement to wear an electronic monitoring device.

The decision immediately sparked a reaction from lawyer Sergio Pisani, representing the Carbonaro family, who described it as a transformation of the parents' grief into a precautionary measure and argued that, in this way, Martina would be "killed a second time."

Since then, Martina's mother has faced trial wearing an electronic bracelet. This also happened on September 9th, when Fiorenza Cossentino appeared before the Assize Court to testify about her daughter's death.

The defense's line: "Outbursts of pain and desperation."

It is precisely on the nature of the sentences uttered and the context in which they were uttered that the appeal to the Review Court now focuses.

According to the defense, the incidents alleged against the Carbonaros should be interpreted in light of the emotional state caused by the loss of their daughter and the direct confrontation with the family of the man accused of killing her.

Lawyer Sergio Pisani argued that these were "mere outbursts of pain and desperation" rather than genuine threats. This is a crucial distinction from a legal perspective, as the defense also disputes the aggravated nature of the alleged conduct.

But there is a further point on which the defense insists: the mother's position.

"Fiorenza never played any active role in the threats for which the measure was granted," Pisani claims. According to him, the documents instead reveal that some unrelated witnesses reported that the woman tried to calm her husband and break up the tense situations.

The Review Court will therefore also be called upon to rule on the individual position of Fiorenza Cossentino.

The trial for Martina's death

The precautionary case is part of the main proceedings for the femicide of Martina Carbonaro.

The 14-year-old girl was killed in Afragola in May 2025 by her ex-boyfriend Alessio Tucci. According to the prosecution, she was attacked and violently hit with a rock inside an abandoned building near the Moccia Stadium. Her body was found the following day, hidden under construction materials and debris. Tucci confessed to the murder and is currently a defendant before the Naples Assize Court.

The trial has entered a particularly painful phase for the family in recent weeks. During her testimony, Martina's mother recounted her daughter's relationship with Tucci and her final hours. The friend who spent part of the afternoon with Martina before she left with her ex-boyfriend also testified in court.

The mother reiterated before the judges a belief and a request that have accompanied the family since the beginning of the proceedings: "Love is freedom, not possession. I want justice."

Two proceedings that are now intertwined

On one side, there's the trial that will determine responsibility for Martina's death. On the other, a precautionary proceeding stemming from tensions between the two families and complaints about alleged threats.

It is on this second front that a new legal game will be played out tomorrow.

The Court of Review will have to decide whether the restraining order and the electronic bracelet should be upheld, revoked, or modified. The discussion will focus on the contested incidents, their actual content, the context in which they occurred, and the roles attributed separately to Marcello Carbonaro and Fiorenza Cossentino.

Meanwhile, Martina's parents remain faced with the legal paradox of undergoing their daughter's murder trial under a precautionary measure that prevents them from approaching the family of the man accused of her death.

Tomorrow, before the review judges, the defense will ask for that provision to be reconsidered.
