Naples, a turning point in the death of Fabio Ascione: the Supreme Court of Cassation dismisses the voluntary homicide charge against Francesco Pio Autiero.

Naples – A major judicial breakthrough redraws the contours of a tragedy that, on April 7, shocked the eastern suburbs of Naples. The Court of Cassation has upheld the appeal filed by the lawyers of Francesco Pio Autiero, 23—the nephew of a prominent member of the De Micco clan of Ponticelli—eliminating the manslaughter charge against him. The case now returns to the Court of Review for a reassessment of the prosecution's case.

The night's news and the lightning investigation

The events date back to the first light of dawn on April 7, 2026. Fabio Ascione, a twenty-year-old with no criminal involvement whatsoever, was returning home after a hard night's work when he was struck in the chest by a fatal bullet.

The investigation conducted by the Carabinieri, coordinated by the Anti-Mafia Prosecutor's Office and the Juvenile Prosecutor's Office, allowed the complex and dramatic events to be reconstructed in record time. A few days after the crime, on April 14th, Autiero decided to turn himself in, accompanied by his lawyer, Leopoldo Perone, at the Carabinieri in Poggioreale, where he was served with an arrest warrant for voluntary manslaughter aggravated by mafia methods, as well as for illegal possession and carrying of a firearm.

The firefight and the tragic fatality

According to the Carabinieri investigation, the tragedy was the culmination of an escalation of tension that had escalated a few hours earlier. Autiero, accompanied by a 17-year-old accomplice, had engaged in a violent firefight with a group of rivals belonging to the Veneruso-Rea clan of Volla, who were accused of trespassing in a dark-colored SUV into territory controlled by the De Micco family in Ponticelli.

The most painful investigative breakthrough emerged from the reconstruction of the moments immediately following the armed clash. Fabio Ascione was standing a very short distance—just forty or fifty centimeters—from Autiero, who, still with the smoking gun in his hand, was excitedly boasting to those present about how he had managed to repel the rival commando.

It was in those moments of tension and boasting that an accidental shot was fired from the weapon he was holding. The bullet struck the young worker square in the chest. "Hey, he hit me," Ascione muttered before collapsing to the ground, lifeless. Despite his desperate rush to help, there was nothing that could be done for the twenty-year-old.

The legal battle and future developments

With today's decision by the Supreme Court—which upheld the defense arguments of attorneys Leopoldo Perone and Sara Piccini—the most serious crime alleged by the Naples Prosecutor's Office is dismissed. The legal proceedings now return to the Court of Review, which is called upon to reconsider the charges and redefine the scope of criminal liability for a case that continues to leave profound scars on the Ponticelli community.
