Abusive construction in Agerola: new demolition ordered by the Prosecutor's Office

As part of the fight against illegal construction, a demolition was carried out in the Agerola area following a court order issued by the Torre Annunziata Court, Gragnano branch.

The rural building in reinforced concrete, divided into three levels of approximately 79 m2 each and with a sloping wooden roof, was intended for storage and was located in via Casa Coppola snc. The second level had no side closures, while the other two were in a rough state, signs of an unfinished construction.

The complex falls within an area subject to significant constraints: landscape and environmental constraint pursuant to Legislative Decree 42/2004, with the entire municipal territory of Agerola declared to be of notable public interest; constraint of the Monti Lattari Regional Park; category 3 seismic zone; high landslide risk zone (P3).

The project responds to the judicial authorities' requirement to restore the damaged environmental conditions and provide a deterrent to illegal construction. In this specific case, the demolition was carried out by the owner under a self-demolition regime, with no advance payment from the affected municipality or the Cassa Depositi e Prestiti. This was made possible thanks in part to the ongoing awareness-raising efforts promoted by the competent office.

This episode demonstrates the effectiveness of a regulatory instrument that combines punitive and preventive purposes, essential for protecting the land and ensuring compliance with urban planning and environmental regulations. Going forward, continuity and synergies between the judiciary, local authorities, and active citizens are needed to consolidate a culture of legality and landscape stewardship.
