Naples – "I have wholeheartedly signed the appeal for a responsible pardon promoted by jurists and magistrates, and supported by the Italian Episcopal Conference. I did so because we can no longer simply register a daily tragedy with superficial disdain."
This was stated by Samuele Ciambriello, Guarantor of the rights of persons deprived of personal liberty of the Campania Region and Spokesperson of the National Conference of Territorial Guarantors, announcing his support for the clemency initiative.
"National data on Italian prisons show over 65.900 inmates, compared to just 46.358 places actually available, with 55 confirmed suicides and 196 total deaths since the beginning of the year. We are facing a war bulletin. The state, through its sentences, certifies inhuman and degrading treatment. We need a response to this illegal and dramatic situation," says Ciambriello.
The regional situation is among the most critical. "Our region has some of the most frightening saturation rates in Italy. These aren't just raw numbers, but people crammed into unlivable cells. In Campania, there are two thousand more inmates than the six thousand available," adds the Guarantor.
"Holding people crammed together in these conditions amounts to inflicting inhuman and degrading treatment. This is a clear violation of Article 3 of the ECHR and Article 27 of the Constitution: the State cannot demand compliance with the rules if it is the first to violate them," Ciambriello emphasizes.
Not a "free for all", but deferred clemency and reintegration
Signing the petition, he explains, "means demanding a response to a dramatic, unconstitutional, and illegal situation. We're not talking about a free-for-all, but rather a gesture of clemency with deferred effect, accompanied by training, employment, and social reintegration programs to reduce recidivism and ensure greater safety for all."
"However, no measure will be sufficient without a radical intervention on healthcare and infrastructure," Ciambriello concludes. The appeal for a responsible pardon, which has also been supported by the National Magistrates' Association (ANM), the Criminal Chambers, and the Italian Episcopal Conference (CEI), focuses precisely on a deferred benefit, prepared through support programs, to avoid automatic processes and reduce pressure on the system without compromising collective safety.
