A year removed from management roles in companies and businesses. This is the precautionary measure implemented by the Salerno Financial Police against the legal representative of a private clinic contracted with the National Health Service.
The order was issued by the Review Section of the Court of Salerno at the request of the Vallo della Lucania Public Prosecutor's Office, which had filed an appeal for a reassessment of the evidence gathered during the investigation.
The administrator, along with three other individuals, is charged with conspiracy to defraud a public entity and forgery of a public document. The charges will be evaluated in the subsequent phases of the proceedings.
According to the prosecution, the man allegedly participated in the conspiracy by allowing a doctor with an exclusive contract with a public health agency to perform surgical procedures in the private facility he managed.
According to the Prosecutor's Office, the professional's activities would have allowed him to "mislead" the healthcare company, which would have continued to pay its employee the supplementary monthly allowance provided for by the exclusivity agreement, while the clinic would have "illegally reserved its professionalism and patient referrals."
The investigation had already led, last March, to the execution of precautionary measures against two doctors who worked at the same facility. The investigation also focused on the surgical activity performed at the private clinic contracted by one of the professionals, despite his exclusive employment with a public hospital.
The new measure concerns the administrator of the company that ran the facility where, according to the prosecution, the doctor with the exclusive contract performed the operations.
The intervention by the Guardia di Finanza represents a further development in the investigation coordinated by the Vallo della Lucania Public Prosecutor's Office, which aims to clarify the relationship between private activity, exclusivity constraints, and public healthcare resources.
