the Court of Appeal of Naples
Naples – The judicial chapter surrounding the latest pre-trial detention order targeting the Petrone-Puccinelli clan has been concluded with the first major decisions from the Court of Review. The raid, which led to thirty arrest warrants, dismantled a vast criminal syndicate dedicated to drug trafficking in the heart of Naples, confirming the dangerous nature and extensive reach of the clan.
At the heart of the prosecution's case are not only the statements of collaborators with justice and the meticulous observation of the judicial police, but above all a key investigative element: the high-definition videos captured by a microcamera placed by the Carabinieri directly inside the clan's main drug dealing hub. Images that documented every single phase of the illicit activity, securing the organization's structure.
In examining the merits of the charges, the Eighth Section of the Review Court issued a verdict that, in its main thrust, recognizes the soundness of the investigation coordinated by the Prosecutor's Office.
The judges confirmed the full existence of the crime of conspiracy for the purpose of drug dealing and, a crucial aspect of the entire investigation, the allegation of mafia-related aggravation, recognizing the intimidating power and Camorra-like methodology of the group active in the Phlegraean Fields area.
Despite the general validity of the precautionary order, the preliminary investigations court made a significant reduction in one of the key positions examined by the defense.
The Court accepted the arguments put forward by lawyer Marco Bernardo, Pasquale Sica's defense attorney, deeming the serious evidence of guilt to be completely unfounded.
The decision takes on particular procedural significance considering that the prosecution's case against Sica initially appeared solid and supported by multiple incriminating elements, including the indictment formalized by two recent collaborators of justice, Vigilia (from Soccavo) and Pesce (from Pianura).
For the preliminary hearing judges, however, neither the alleged participation in the criminal association nor the specific drug dealing charges stood up to scrutiny at trial: following the ruling, Pasquale Sica was immediately released from prison.
