The proliferation of vehicles with foreign license plates driven by residents in Italy must not jeopardize the safety of traffic in compliance with the provisions of the Highway Code.
This is the warning launched by the legal commission of the Automobile Club Napoli which, while appreciating the new regulatory provisions on the matter, has identified the persistence of some worrying critical issues.
Given that, at a legislative level, it is not possible to intervene with traffic bans, which have already been "rejected" previously by the European Court of Justice, it is necessary to improve the operational effectiveness of the police forces, through an appropriate reform of the investigation system and access to the State Police database (CED-SDI), together with the implementation of information exchange systems between all the countries of the European Union.
At the same time, the working group that examined the issue, consisting of Deputy Attorney General Valter Brunetti, University Professor Guido Marsiglia, Commander of the Naples Highway Police Maria Pia Rossi, Lawyer Riccardo Satta Flores and General Giuseppe Salomone, believes that a clarifying intervention by the legislator is necessary so that for these vehicles, as stated in Law No. 238/2021 which regulates the matter, the same provisions set out in the Highway Code for vehicles registered in Italy are applied, especially with regard to the obligations of periodic inspection and insurance coverage.
The final proposals will be brought, by the president of ACI Napoli Antonio Coppola, to the attention of the Government and in particular of the Minister of the Interior Matteo Piantedosi. During the meeting, the problems concerning the methods of access to the ZTL of vehicles serving the disabled were also analyzed, which, constituting real "administrative barriers", in fact limit their free circulation.
The conclusions, entrusted to the working group composed of university professor Alfredo Contieri, magistrate Vincenzo Romis and lawyers Riccardo Satta Flores and Paolo Stravino, will be illustrated during a special public conference. At the meeting of the legal commission, chaired by the Attorney General of Naples, Luigi Riello.
Also speaking were: the president of the Campania Regional Administrative Court Vincenzo Salamone, the president of the jurisdictional section of the Campania Court of Auditors Michele Oricchio, the president of the Court of Naples Elisabetta Garzo, the vice-prefect of Naples Roberto Esposito, the president of the second section of the Court of Assizes of Appeal Alfonso Barbarano, the deputy prosecutor Maurizio De Marco, the magistrates Giovandomenico Lepore, Aldo and Marcello De Chiara, the lawyers Daniela Mangiacapra and Cristiano Napoli.
