Benevento: Fatebenefratelli Hospital found guilty of "delays in cancer treatment"; compensation awarded

The Court of Benevento has ordered the Sacred Heart of Jesus – Fatebenefratelli Hospital to pay damages for the medical care of a cancer patient, finding a series of delays and omissions that compromised the woman's treatment options.

The decision is contained in ruling no. 1164/2026, published in July, in which the judge found the facility liable for the failure to promptly diagnose and communicate the results of a histological examination following surgery.

According to the lawsuit, the final report was only available 43 days after the operation. During that time, the patient was not adequately informed of the severity of her clinical condition nor was she referred for immediate oncological treatment. Furthermore, later, during outpatient checkups, some signs of disease recurrence were not promptly identified.

In the Court's assessment, guidelines-compliant behavior and more expeditious case management could have increased the patient's chances of survival: the ruling indicates a 50% greater probability of five-year survival, as well as a longer and better life expectancy.

The judge therefore ordered compensation for damages, recognizing both the biological damage suffered by the patient and the moral and parental damages due to the family members.

Attorneys Augusto Guerriero and Annunziata Pepe, who assisted the family in the case, expressed their satisfaction. "This decision is fundamental for the protection of patients' rights," the lawyers stated, "and reaffirms the responsibility of healthcare facilities in the event of serious omissions. The ruling sets an important precedent in the fight against medical malpractice and protects citizens' constitutional right to receive timely, transparent, and fair care."

The measure thus reopens the issue of healthcare liability and the importance of timely diagnosis and treatment, especially in oncology cases where even delays can impact therapeutic options.
