The Preliminary Investigations Judge of Benevento has ordered the release from prison of a 23-year-old arrested for drug possession, applying a residence ban instead and downgrading the crime to a minor one.

A 23-year-old man, arrested by the Carabinieri of Benevento for possession of approximately 50 grams of cocaine, hashish, and a substantial sum of money, has been released by the Preliminary Investigations Judge of the Court of Benevento.
During the validation hearing, the Public Prosecutor had requested house arrest, but the judge opted for his release, imposing a ban on the boy from residing in the municipality of Benevento. The decision granted the defense's request, which resulted in the charge being upgraded from a more serious offense to that provided for by Article 73, paragraph 5, of Presidential Decree 309/1990, which refers to minor drug-related offenses.
This is the young man's second arrest in just a few months, having previously been arrested in March 2026. Assisted by lawyer Gerardo Giorgione, the young man benefited from a provision that follows the most recent guidelines of the Court of Cassation, distinguishing between ordinary drug dealing and minor crimes.
