Naples — The affair that has engulfed the regional councilor for Territorial Government and Heritage, Enzo Cuomo, former mayor of Portici, has brought renewed attention to a long-standing issue: the rules governing mayoral candidacies in regional elections. The issue has been raised by Francesco Morra, president of ANCI Campania, who once again calls for "equal treatment and clear rules" for mayors who choose to run for the Regional Council.
"The Cuomo case further highlights an issue we, as ANCI Campania, have been raising for some time," Morra said in a statement released today. "This isn't a battle tied to a single case, but an issue that concerns all mayors and, above all, community representation."
The president of the Association of Campania Municipalities notes that the Constitutional Court has already clarified the current regulatory framework, but what's happening in recent weeks demonstrates "how important it is to open a serious and comprehensive discussion on the electoral law in the Regional Council."
According to Morra, "we need to build clear, balanced, and equal rules for the future." Mayors, he emphasizes, "directly represent their communities and cannot be penalized in their access to regional representation: they are a resource for the institutions and must be considered as such."
The position taken by ANCI Campania comes amid a raging political battle over the alleged incompatibility of Cuomo, who was appointed councilor on December 31, the same day he resigned as mayor of Portici. The Ministry of the Interior, responding to a question from Senator Sergio Rastrelli (FdI), argued that the former mayor was ineligible for the regional councilorship, as the twenty-day period following his resignation, as required by Article 53 of the Consolidated Law on Local Authorities, had not yet elapsed.
The Regional Council responded by arguing that at the time of the first available session (26 January 2026) the deadline had regularly expired, and that the TAR had already rejected an application for precautionary suspension of the appointment.
Morra, however, shifts the focus to the regulatory level: "We have already raised the issue of the rules governing mayoral candidacies in regional elections, calling for rules that both safeguard territorial representation and the administrative continuity of municipalities."
