Benevento, found with 140 grams of cocaine: the judge reclassifies the crime. Sentenced to "only" eight months.

Benevento – He was stopped by police in August 2025 and found in possession of approximately 140 grams of cocaine. This charge led to his arrest and, subsequently, the prosecutor's request for a four-year prison sentence.

The proceedings concluded this morning before the Benevento Court with a significantly different decision than the prosecution's request. The judge, after evaluating the evidence gathered during the proceedings and the defense's arguments, reclassified the case as a less serious offense, sentencing MG, 32, to eight months in prison.

The reconstruction of the defense

The hearing focused on the circumstances of the inspection and the evidence supporting the indictment. The defense, represented by attorney Gerardo Giorgione, presented the judge with a different reconstruction of the facts, requesting a comprehensive assessment of the findings of the proceedings.

According to the defense's argument, the examination of the evidence collected would have allowed them to exclude the possibility of the more serious hypothesis initially contested and to place the defendant's conduct within the scope of a less severe offence.

From the request of four years to eight months

The gap between the Prosecutor's Office's request and the Court's decision is therefore significant: the prosecutor had requested four years of imprisonment, while the sentence imposed was eight months, following the legal reclassification of the crime.

According to the defense, the principles outlined by the Supreme Court of Cassation, which were recalled during the hearing, also played a role in the decision.

The Court's decision

The judge therefore deemed it possible to configure a less serious offence, modifying the legal classification of the conduct contested by MG and consequently redetermining the sentence.

The ruling currently concludes the proceedings before the Benevento Court, with a significantly lower sentence than the one requested by the prosecution. The decision was reached after examining the trial results and the arguments put forward by the defendant's defense.

Editorial note: I would avoid calling MG a "pusher" or stating that the 140 grams were intended for drug dealing, because the reconstruction provided does not show that this has been definitively ascertained: the central point of the ruling is precisely the reclassification of the fact into a less serious hypothesis.
