

Naples, serious brain injury after accident: €150 compensation awarded
Naples – A serious injury sustained in a car accident, consequences that only became fully apparent over time, and a medical-legal battle that culminated, at least for now, in a €150 settlement. This is the story of a young man who was seriously injured in an accident in Naples when he was just eighteen.
The boy was traveling as a passenger in a car driven by a friend. The car, for reasons that will be the subject of an investigation and subsequent trial, collided with another car. The drivers of both vehicles suffered minor injuries, while the young man remained trapped in the passenger compartment, requiring the intervention of the fire department.
Emergency services from 118 also arrived on the scene. The boy was taken to the hospital and subsequently began a long course of treatment and rehabilitation.
Initially, it seemed the young man had made a satisfactory recovery. As time passed, however, increasingly evident signs of a change from his pre-accident condition emerged.
Memory problems, comprehension difficulties, and behavioral changes began to impact his daily life. Among the aspects highlighted was a progressively slovenly demeanor, considered by family members and professionals who followed the case as a significant change from his pre-traumatic personality.
It is precisely the late evolution of the symptoms that has assumed a central role in the compensation case.
According to Studio Associato Maior, the case came to the attention of its professionals after having already been handled by four different law firms.
The insurance company had made an initial offer in the range of tens of thousands of euros. This figure was deemed inadequate given the true extent of the damages, in light of further medical-legal and specialist assessments conducted.
The team in charge of the study then investigated the neurological consequences reported by the young man, identifying serious damage to the cerebral cortex, attributable to a prefrontal lesion.
An injury that, according to the assessment of the professionals assisting the boy, would have had repercussions on his cognitive abilities and behavior.
Based on the investigations carried out, the insurance company awarded compensation of 150 thousand euros.
The amount, however, would not represent the final resolution of the dispute. The award was in fact made taking into account contributory negligence related to the failure to wear a seat belt.
Maior Law Firm advised its client to accept the sum as a down payment, while simultaneously pursuing legal action to obtain any additional compensation.
This is one of the main issues that will have to be addressed in the trial.
According to the argument put forward by the young man's lawyers, in fact, the use of the seat belt would not have avoided or reduced the consequences of the impact in the specific circumstances of the accident.
The study's argument is linked to the conditions of the passenger compartment: the part of the car occupied by the passenger would have completely crumpled right at the point affected by the impact.
The legal proceedings will now determine the actual impact of this circumstance on the dynamics of the injuries and, consequently, on the amount of the overall compensation.

Lawyers Michele Francesco Sorrentino, Pierlorenzo Catalano, and Filippo Castaldo are following the case, with the support of medical examiner Marcello Lorello.
"This result demonstrates the importance of examining the long-term consequences of a serious trauma," emphasize the professionals at Studio Associato Maior.
The case, therefore, has not yet reached its conclusion. The award of €150 represents, according to the study's reconstruction, a significant first result, while the legal battle will continue to obtain full recognition of the damages the young man allegedly suffered as a result of the accident.
