Porsche Macan rigged for sale: dealership owner requested trial

Caserta – A cashier's check for €42.500 to drive a flaming dream: a Porsche Macan. A purchase that, according to the buyer, was supposed to guarantee performance and reliability, but instead turned into a legal dispute.

At the heart of the judicial investigation is a specific yet insidious investigative theory: the vehicle was digitally "cleaned" to hide structural flaws and defects before being put on the market.

In this case, the Prosecutor's Office has formally requested the indictment of Salvatore Carcchia, owner of the dealership "BD Auto srl." The defendant is scheduled to appear before a judge on June 9, 2027, the date on which the pre-trial phase to determine any criminal liability will officially begin.

According to investigators' reconstruction, the conduct alleged against Carcchia was not limited to a simple omission, but rather an active and targeted intervention on the technological heart of the German SUV. The defendant, exploiting technical expertise or employing expert hands, allegedly electronically altered the engine's control units and wiring.

What was the purpose of this intervention? According to the prosecution's theory, the tampering was intended to systematically hide warning lights and fault alerts, effectively suppressing any warning signals related to alleged vehicle malfunctions. A veritable digital makeover that would have deceived the buyer, pushing him to shell out the agreed-upon sum for a car that, in fact, could not be used safely or according to the agreed-upon conditions.

The crimes charged and the defense strategies

Articles 81 and 640 of the Criminal Code are triggered: the case is headed to the courtroom.

The facts at the center of the criminal case date back to a period before and around January 29, 2024, with the alleged crimes taking place in the Macerata Campania area. At the end of the preliminary investigation, the evidence gathered by the Prosecutor's Office prompted investigators to request a trial.

Carcchia is charged with the crimes set forth in Articles 81 and 640 of the Criminal Code, alleging continued fraud aimed at obtaining an unfair financial profit, resulting in evident financial damage to the purchasing party.

The legal battle is set to be a tough one, even on the judicial front: the injured party has entrusted the legal representation of lawyer Gaetano Petrone, who is ready to join the civil action seeking compensation for damages, while the defendant's defense has been assumed by lawyer Giuseppe Amato, who will be tasked with dismantling the prosecution's case during the hearings.
