Sant'Antonio Abate: An illegal swimming pool demolished: the structure was built in 1999.

Sant'Antonio Abate – An in-ground swimming pool made of reinforced concrete, with a sheet metal frame and waterproof lining, was demolished in Sant'Antonio Abate, on Via Santa Maria La Carità, as part of the anti-illegible building campaign coordinated by the Torre Annunziata Public Prosecutor's Office.

The work was carried out in compliance with a demolition order issued by the Torre Annunziata District Court, Gragnano branch, relating to an illegal building dating back to 1999.

The swimming pool and the facilities

The building, which served the main residence, occupied a floor area of ​​approximately 72 square meters, with a basement volume of approximately 146 cubic meters.

The facility was complete with all the technological systems necessary for its operation and was built in a particularly sensitive area from the point of view of environmental and land protection.

An area subject to several constraints

The area affected by the illegal construction is in fact subject to landscape restrictions, pursuant to Law 1497/1939, imposed by Ministerial Decree of 28 March 1985 and subsequently confirmed by Legislative Decree 42/2004.

Furthermore, the area is subject to a hydrogeological constraint, established by Royal Decree 3267 of 30 December 1923.

The area also falls within seismic zone 3, according to the classification established by Prime Ministerial Decree 3274/2003 and the subsequent resolution of the Campania Regional Council of 7 November 2002.

Car demolition at no cost to the municipality

The demolition was not carried out directly by the municipal administration, but by the owner of the building through the self-demolition regime.

This approach, the Prosecutor's Office emphasizes, allowed the restoration of the site without any advance costs being incurred by the affected Municipality or the Cassa Depositi e Prestiti.

The intervention thus represents the execution of a sentence relating to an abuse dating back more than twenty-five years.

The Prosecutor's Office's stance against illegal building

The Torre Annunziata Public Prosecutor's Office considers the demolition of illegal structures ordered by the judicial authorities to be a fundamental tool for protecting the territory.

According to the Judicial Office, the demolition of illegal buildings serves a dual purpose: repressive, by restoring the violated environmental and urban planning conditions, and preventative, by deterring further illegal construction.

In the case of Sant'Antonio Abate, the public prosecutor's office's outreach efforts helped encourage the owner to self-demolish the building, allowing a legal case related to work completed in 1999 to be resolved.
