He killed his elderly wife by suffocating her with a pillow. Today the judges of the Second Section of the Court of Assizes of Appeal of Naples reduced the sentence from 21 to 14 years in prison.
The unusual femicide, given that we are talking about very old people, occurred on the night of May 5, 2021 in Avellino. He, Gerardo Limongello was 85 years old and she, Antonietta Fucuciello was 83 years old.
Limongiello was sentenced by the Avellino Court of Assizes in the first instance in November 2022 to 21 years of imprisonment for aggravated voluntary homicide. In 2023 he appealed against the first instance sentence of the Court of Avellino, an appeal that was discussed this morning before the II section of the Court of Assizes of Appeal of Naples.
Following a long discussion of the defense of the elderly man represented by the lawyer Mario di Salvia today replaced by the lawyer Lanzano, the Court retired to the council chamber for the decision accepting the appeal and significantly reducing the sentence imposed in the first instance from 21 to 14 years of imprisonment.
The Attorney General, who had asked for the first degree sentence of 21 years to be confirmed, held a different opinion.
Limongello has not been burdened by any precautionary measures for some time following the revocation of all restrictions pronounced last year by the same Court of Appeal of Naples at the request of the defense.
Satisfaction was expressed by the legal attorney Mario di Salvia who declared: “Limongiello was a self-confessed criminal, so we never dared to ask for his acquittal but for a significantly milder sentence, something we had invoked with pertinent legal support since the first degree of judgment, a request that was fully accepted today.”
