Desiderio Clan: DIA confiscates €5 million from businessman

Salerno – The assets estimated at approximately €5 million are at the center of a preventative measure carried out by the Salerno Anti-Mafia Investigative Directorate against a Mercato San Severino businessman believed to be linked to the Desiderio clan, a criminal organization operating in the Irno Valley.

The DIA executed a confiscation order issued by the Review and Preventive Measures Section of the Court of Salerno, upon joint proposal by the Public Prosecutor of Salerno and the Director of the Anti-Mafia Investigative Directorate.

The measure concerns companies, real estate, and financial assets that, according to investigators, are owned or at least available to the entrepreneur.

The assets were confiscated

Specifically, the measure concerns a factory, three entire business complexes operating in the trade show and event equipment rental and setup sector, a sole proprietorship operating in the catering industry, as well as pension fund shares and postal savings bonds.
A complex estate, therefore, built up through various entrepreneurial activities and which, according to the approach accepted by the Court of Salerno, would not have been consistent with the income capacity formally declared by the interested party.

It was precisely the reconstruction of the economic flows and the financial assets that played a central role in the DIA investigation, which worked to reconstruct the entrepreneur's profile and his connections with the criminal underworld of the Irno Valley.

The social danger reconstructed by the DIA

The confiscation order comes at the end of a complex investigative effort conducted by the Salerno DIA Section, aimed at reconstructing the entrepreneur's social dangerousness profile.
According to the ruling, the Court recognized the existence of both generic social dangerousness, identified in the period between 2009 and 2021, and qualified social dangerousness, referring instead to the years 2015-2017.

The man is believed to belong to the Desiderio clan, a criminal group believed to operate in the Irno Valley area. He is also implicated in bankruptcy proceedings, another factor taken into consideration in the overall investigative reconstruction.

The asset prevention measure, however, is based on the distinct assessment required by anti-mafia prevention legislation: on the one hand, the assessment of social dangerousness, on the other, the verification of the origin and size of the assets attributable to the individual.

The disproportion between income and assets

One of the key factors identified by investigators is the disproportion between the entrepreneur's assets and his income.
According to the reconstruction contained in the note from the Salerno Public Prosecutor's Office, this disproportion would have constituted an indication of the possible illicit origin of the resources used to accumulate the assets.

Salerno's prosecutor, Raffaele Cantone, in announcing the execution of the order, highlighted this very aspect, citing evidence gathered by the DIA (Intelligence Department) which, according to the hypothesis accepted by the Court, would suggest that the entrepreneur had derived support from criminal activities.

The confiscation therefore represents the culmination of a patrimonial prevention proceeding in which the reconstruction of the financial resources was intertwined with that of the entrepreneur's relationships with the criminal context of the Desiderio clan.

The total value of the confiscated assets is estimated at approximately €5 million. This action affects not only financial resources, but also economic activities and production facilities attributable, according to the provision, to the entrepreneur's resources.
