Naples: Martina Carbonaro's parents have had their ban on approaching Tucci lifted.

Naples – The Naples Court of Review has revoked the restraining order, with the application of an electronic bracelet, issued last July by the preliminary investigations judge of Naples North against Marcello Carbonaro and Fiorenza Cossentino, parents of Martina Carbonaro, the 14-year-old stoned to death on May 26, 2025, in Afragola by her ex-boyfriend Alessio Tucci, now 19 and a self-confessed criminal.

The decision of the Review

The panel granted the request submitted by the Carbonaro family's defense, represented by attorney Sergio Pisani, deeming that the conditions for maintaining the precautionary measure no longer existed. According to the lawyers, the alleged incidents—episodes of tension and verbal altercations with some of the defendant's family members recorded during the hearings at the Assize Court—should be considered "mere outbursts of grief and desperation," and not actual threats, which are also alleged in the aggravated form.

The reasons for the defense

The defense also raised issues of compatibility between the statutory limits of the alleged crime and the application of a measure restricting personal freedom, such as a restraining bracelet. Essentially, the lawyers for Martina's parents argue that the severity and current nature of the danger required to justify the measure do not exist.

The procedural context

The measure was ordered after several tense moments in the courtroom between the Carbonaros and Tucci's family, in the aggravated voluntary manslaughter trial underway before the Naples Assize Court. Fiorenza Cossentino, known as Enza, had already testified on September 9th, wearing an electronic bracelet, reconstructing Martina's final hours and denouncing the "calm" behavior of her daughter's ex-boyfriend even after the murder.

The mother's words

In court, the mother said she had "treated Tucci like a son" before he killed Martina: "He stabbed me too. I will never forgive him," she said, demanding "true justice" and clarification of any possible accomplices. The lifting of the restraining order does not affect the trial on the merits, where Tucci is charged with aggravated homicide for the death of the 14-year-old, who was struck multiple times in the head with a rock after repelling his advances.
