Naples. The film inspired by the dramatic story of little Fortuna 'is not speculative' and will be released in theaters: the judge ruled, rejecting the parents' request to block the feature film.
“The artistic work, although inspired by the sad story of Fortuna Loffredo, must be considered free of speculative intent to exploit the image or the processing of personal data… and rather embodies the author's desire to raise public awareness on the delicate issue of violated childhood…”. Writes the sole judge of Naples Valeria Rosetti who today rejected the request with which Pietro Loffredo and his lawyer, Angelo Pisani, asked to block the release of the feature film “Fortuna – The giant and the girl”, directed by Nicolangelo Gelormini, inspired by the tragic story of Fortuna Loffredo, daughter of Pietro Loffredo and Domenica Guardato, killed at the age of 6, on June 24, 2014, in the Iacp Park of Caivano, in the province of Naples, after an attempted sexual abuse to which the little girl had rebelled. Pietro Loffredo was also sentenced to pay the considerable legal costs.
Yesterday, in court, the day the film was released in theaters, lawyer Pisani and the lawyers of Dazzle Communication, Indigo Film, Rai Cinema, I Wonder Pictures and the director battled it out before the judge of the first civil section of the Court of Naples. Lawyer Pisani has a completely different opinion regarding the reasons for the sentence and, in his request, appealed, among other things, to respect for the right to be forgotten and privacy: "We will challenge the decision," the lawyer announced, "which inflicts a further blow to the Loffredo family. We are waiting to see how the criminal justice system and the Privacy Guarantor will decide. You cannot shape people's lives like you do with plasticine," Pisani concluded, "especially for commercial interests: I don't think this is art, but the alteration of reality for one's own interests."
“The ruling issued this morning clears the field with extreme clarity of any possible shadow cast on 'Fortuna', rejecting the appeal presented and condemning the applicants to pay the legal costs,” writes Davide Azzolini of Dazzle Communication, which produces the film with Indigo Film and Rai Cinema, in a note. “We deeply respect the pain of Fortuna Loffredo's parents and we cannot even imagine how much they have experienced and are forced to experience every day. This is the reason why our film has always had as its guiding star the absolute respect for the memory of a little girl whose martyrdom can only be approached with attention, respect and delicacy: this is what Nicolangelo Gelormini did, choosing to make his first feature film inspired by this story and making a film full of poetry, as recognized by the Italian and international reviews of critics who have seen it,” concludes Azzolini.
