Before being killed, he was beaten and then his body was disemboweled and decapitated. This is how the Indian farm worker Gurinder Singh died, whose remains were found on February 8 last year in an uncultivated field not far from the provincial road 10/A between Contursi Terme and Palomonte, in the province of Salerno.
For that crime, the Salerno Review Court, after the appeal of the prosecutor, overturns the decision of the investigating judge and orders the precautionary measure of detention in prison for SD, a compatriot of the victim with whom he shared the same house and work in a buffalo farm in the area. The precautionary measure, however, is not enforceable because the terms for its possible appeal before the Supreme Court are pending.
According to the investigators' reconstruction, Gurinder Singh, who had been legally residing in Italy since 2011 and in Campania since August 2021, had been brutally beaten before being killed - in fact, numerous fractures were found to the nasal septum, the jaw and the right tibia - then disemboweled and beheaded. According to the accusations, the murder was based on personal conflicts between the victim and the suspect.
They both lived in a small prefabricated building of a few square meters, made available to them by their employer.
The investigators arrived at SD thanks to the forensic investigations, after finding traces of blood, compatible with the genetic profile of the victim, inside the suspect's car, on some of his clothes and also inside that prefabricated building which, after the victim's disappearance, had been inhabited only by the suspect.
The investigating judge, however, highlighted gaps in the investigations and, in particular, the failure to use the 'Bloodstain Pattern Analysis' technique, i.e. the scientific analysis of the trajectories of blood spatters. Therefore, he deemed those blood traces insufficient, also taking into consideration some statements made, during the defensive investigations, by some witnesses who claimed to have noticed the victim alive until the morning of December 28, 2022, therefore at a time after or in any case concomitant with the departure of the suspect for his country of origin.
The Review Court, however, considering suspicious the very circumstance of the departure of the accused, which occurred suddenly, with a plane ticket for an intercontinental flight purchased a few hours before the trip, without any warning and without any baggage being checked in, reached conclusions opposite to those of the investigating judge.
