IThe Justice of the Peace of Acerra, Nicola Ricciuto, has ordered the Societa' Sportiva Calcio Napoli to compensate the parents of an under-14 fan who had purchased, over the last ten years and up until 2018, 27 full-price tickets to access the San Paolo stadium (now Diego Armando Maradona) despite having the right to free entry (gratuito, rpt).
The blue company, through a sentence last August and made public today, was found guilty of not having indicated 50% of the matches, of each single championship and cup, including European ones, to which under 14s could access, free of charge, with a paying adult, in each sector of the stadium.
The Court of Appeal of Naples, last June 25, rejected the request of SSC Napoli and confirmed, with its ruling, the correct interpretation of a 2007 law (specifically article 11 ter of law 41) which required sports clubs, with facilities with more than 7.500 seats, to reserve, for 50% of the matches organized in the year, free tickets to minors under the age of 14 accompanied by a parent or a relative up to the fourth degree, as established by the Court of Naples (judge Valletta).
“The decision – the lawyer specifies Erich Grimaldi, legal representation of the parents of the minor fan – who obtained such measures will have effect against all the Serie A and B clubs, which have violated the aforementioned law and will open the way to many compensation actions for all those who are in possession of tickets purchased, for minors, in the last ten years”.
