He confirmed to the investigating judge of the Juvenile Court that Napoli,Valeria Veschini, the confession made during interrogation at the police station, the 16-year-old who at dawn on August 31, in the central Piazza Municipio, killed the 24-year-old musician Giovanbattista Cutolo with three gunshots at the height of an argument that broke out over a badly parked scooter.
The hearing lasted about an hour and a half. The young man – according to his lawyer, the lawyer of the Bar of Santa Maria Capua Vetere Davide Piccirillo – seemed more aware of the tragedy caused and with a more submissive attitude than the one shown during the arrest.
He told the judge that he was just defending himself and that the gun – found and owned by the group – was passed to him by one of his friends, an adult, who took part in the fight. The young man reported that he shot while Cutolo was approaching him in a threatening manner.
“He was coming in front of me in a threatening manner and I shot him.” The gun? “It belonged to the group and an adult friend of mine passed it to me. I didn’t want to kill him, I just wanted to defend myself.”
The investigating judge tried to get the suspect to tell him where the gun came from and, above all, which of the boys involved was keeping it.
The prosecutor Francesco Regine asked the judge to place the 16-year-old in prison while the lawyer instead called for house arrest or, alternatively, placement in a community.
The investigating judge of the Juvenile Court of Naples, Valeria Veschini, has validated the arrest warrant and ordered the detention in a juvenile penal institution for the 16-year-old who confessed to the crime.
Deputy Prosecutor Francesco Regine and the Naples Flying Squad are charging the 16-year-old from the Spanish Quarters with aggravated voluntary homicide and possession, illegal carrying and receiving of a weapon.
