IThe Court of Appeal of Salerno rejected the request of the Prosecutor's Office to suspend Enrico Coscioni from the presidency of Agenas, the National Agency for Regional Health Services. The decision confirms what was already established by the preliminary investigations judge (GIP) last March, against which the Prosecutor's Office had appealed.
Enrico Coscioni is accused by the Salerno Prosecutor's Office of being responsible for the death of a patient undergoing aortic valve replacement surgery. During the autopsy, in fact, it was discovered that a flap of gauze had been left inside the patient's body, causing his death. The object was removed during the autopsy.
In March, the investigating judge had imposed a 12-month ban on Coscioni from practicing medicine, which also included his suspension from the direction of the Cardiac Surgery department at the “San Giovanni di Dio e Ruggi d'Aragona” hospital in Salerno, where the episode had occurred. However, the judge denied the request for suspension from the presidency of Agenas, a decision now confirmed by the Review Court.
Despite the confirmation of the Review, a possible removal of Coscioni from the presidency of Agenas remains pending, which could be decided by the State-Regions Conference at the request of the Ministry of Health. For the moment, Enrico Coscioni remains at the helm of Agenas.
Lawyer Agostino De Caro, who is defending Coscioni together with lawyer Gaetano Pastore, stated that his client is currently suspended only from medical practice and that there are no interdictory measures affecting his public offices.
