The defendant, Cesare Pugliese, 58 years old, has requested a sentence of just two years with conditional suspension, a proposal agreed with the Public Prosecutor of the Nola Prosecutor's Office, Aurelia Caporale.
The hearing, scheduled for Friday, February 21 at 9:XNUMX a.m., will be decisive. The preliminary investigations judge of the Court of Nola, Fortunata Basile, will have to express an opinion on the request that, for the boy's parents, represents a mockery. If accepted, in fact, there will be no trial and the person responsible for the accident will serve a sentence that the family considers inadequate for the gravity of the facts.
The accident and the responsibilities
The tragedy occurred on May 18th in via Napoli, in Casalnuovo. Gennaro, on board his scooter and in full compliance with traffic regulations, was the victim of a fatal maneuver: Pugliese, driving a Ford Fiesta, suddenly opened the car door, without checking whether the young man was coming.
The impact threw the boy into the opposite lane, where he was hit by a Fiat Tipo. The serious injuries he suffered – a cranial-thoracic trauma with cerebral hemorrhage and pulmonary contusions – left him no escape. After ten days of agony at the Cardarelli hospital in Naples, Gennaro He died on May 27, leaving his family in despair.
The investigations confirmed the full responsibility of Pugliese, accused of road homicide for "imprudence, negligence, incompetence and violation of traffic regulations". The man had parked in a prohibited area and opened the door without checking, causing the tragic chain of events.
The family's appeal
Supported by Studio3A-Valore SpA, specialized in the protection of citizens' rights, Gennaro's parents ask for justice. "We are aware that no punishment can ever repay us for the loss of our son - they declare - but two years with a suspended sentence are an offense to his memory".
The family is appealing to the judge to reject the agreement and refer the case to the PM for a more severe sentence, appropriate to the seriousness of the crime. Friday we will know if justice will listen to them.
