Dure sentences, also in the second degree, for the two young adults held responsible for having robbed, on January 2, 2021, in NAPLES, the scooter of the rider Gianni Lanciato: the second section of the Court of Appeal of NAPLES confirmed the ten years of imprisonment inflicted on Vincenzo Zimbetti and Michele Spinelli by the preliminary hearing judge of NAPLES North at the end of a trial celebrated with the abbreviated rite. Zimbetti and Spinelli were defended, respectively, by the lawyers Giovanna Cacciapuoti and Francesco Buonaiuto, and by their colleagues Diego Abate and Carlo Bianco.
The sentence, according to Zimbetti's lawyers, Cacciapuoti and Buonaiuto, "is particularly severe and does not grant any discount to the two boys, despite their young age and the repentance shown by their confession, a letter of apology and also through the compensation for damages, which led to the revocation of the civil action by the victim".
“As always,” Cacciapuoti and Buonaiuto emphasize, “we respect the decisions of the magistrates, but we believe that such a severe sentence betrays the re-educational function of punishment, which is a foundation of our penal system, especially when it comes to such young defendants.”
Minors also took part in the attack on the rider: the judges of the Juvenile Court gave three of the youths a much more lenient sentence, 4 years and 3 months, while the sentence for the fourth was reduced to 3 years and 4 months because he had not taken part in another similar robbery that preceded the one on the rider.
