The Guardia di Finanza of Naples has executed a preventive seizure order aimed at confiscation against FG, director of a company operating in Casoria in the road freight transport sector.
The provision, issued by the GIP of the Court of Naples North, was adopted following a complex investigative activity coordinated by the Public Prosecutor's Office of Napoli North.
The investigations have ascertained that FG, together with other suspects, carried out a series of fraudulent conducts that led to the bankruptcy of the company.
In particular, the defendants systematically failed to pay taxes for approximately 1 million euros, generating a progressive accumulation of debts and causing the company to go bankrupt.
Furthermore, the defendants stole the business goodwill, significant financial resources, numerous vehicles and road trailers from the insolvent company, transferring them to two specially created “clone” companies.
The precautionary seizure concerned 99% of the company, with a prudentially estimated asset value of 5,7 million euros.
The defendants FC, MA and GA, de facto administrators and the legal administrator, were also notified of a notice of conclusion of the investigations, with which they were charged with administrative liability for the crime provided for by Legislative Decree no. 8 of 2001 June 231.
This investigation is part of a broader investigative line launched by the Public Prosecutor's Office of Naples North on serious episodes of bankruptcy and money laundering by entrepreneurs who have companies based in this area.
To this end, a protocol was recently approved between the President of the Court of Naples North and the Public Prosecutor, aimed at giving further investigative impetus to the fight against corporate crimes.
The Public Prosecutor's Office of North Naples, in synergy with the Guardia di Finanza, is constantly engaged in combating illegal economies that pollute the economic fabric of the territory.
