The Court of Cassation of Rome, Third Criminal Section, presided over by Dr. Vito De Nicola, has put an end to the legal case involving Michele Ponticorvo, 67, and Antonino Ponticorvo, 43, well-known entrepreneurs from Alvignano who have been active in the dairy sector for generations.
The Supreme Court has annulled without referral the ruling of the Court of Appeal of Napoli, fully accepting the appeal presented by the lawyers Raffaele Gaetano Crisileo and Gaetano Crisileo, defenders of the two defendants.
Father and son, owners of the Ponticorvo dairy company, had been sentenced in the first instance by the Court of Santa Maria Capua Vetere and on appeal by the Neapolitan Court to six months of imprisonment each for the crime of aggravated complicity in the violation of seals.
The charge concerned the alleged removal of seals affixed by the ASL Veterinary Service on a batch of 11.000 kg of powdered milk intended for human consumption, transferred to another company without authorization for release from seizure.
The case arose from an inspection conducted jointly by ASL inspectors and NAS Carabinieri at the Ponticorvo plant in via Olivella in Alvignano. During the inspection, the inspectors had contested the disappearance of the goods previously seized, thus starting the investigation.
The Court of Cassation, fully sharing the defense's arguments, ordered the acquittal of Michele and Antonino Ponticorvo, recognizing the groundlessness of the accusations and closing a case that had marked the reputation of a family that has always been linked to the dairy tradition of the area. An epilogue that restores serenity to entrepreneurs and confirms trust in justice.
