Lawyer Mattia Grassani he spoke to Radio Marte about the appeal for Osimhen's two-match disqualification.
“Appeal for osimhen? Access to the documents has not yet been proposed, also because the break in Serie A for the national teams will allow us to address the issue more calmly and in depth. The first step - choosing or not to access the documents - expires 48 hours after the date of communication of the decision. So tomorrow Napoli will have to lay down its cards and decide whether or not to submit the request to evaluate the reconstruction given for the decision of the Sports Judge. The possibility that Napoli will proceed with the appeal is more than a hypothesis, let's prepare for the battle.
Cancel the disqualification for Genoa too? The sources we rely on today are the television ones, the exchanges of reports between VAR and officials on the field are still missing. It is quite forced that one can think of canceling the two days of disqualification, we reason with the view of not having it usable for the next one and we will focus exclusively on the second day of the match and the cancellation of the fine.
The reasoning of the Sports Judge adopted in the Immobile-Vidal case was then a one-day disqualification and a fine of 10.000, in our case instead 2 days and 5000 euros. In that case we were talking about seriously unsportsmanlike conduct, which is not included in the Osimhen case.
The sports jurisprudence of the Sports Judge in Serie A has presented other cases. This is the most recent and most overlapping. In that case it was a slap when the game was stopped. In our appeal there will also be the circumstance that the ball was absolutely not out of the playing distance of Osimhen himself, when he frees himself from the equally irregular grip of the opponent the ball could have been hit by Osimhen, in the case of Immobile it was not.
It will be a matter for the Court of Appeals, which will require uniformity of treatment. Freeing yourself from a very harsh marking with a slap and with the ball abstractly attributable to Osimhen in that playing area cannot cost 2 days and a 5000 euro fine.
The fact that Immobile was already sanctioned with just one match does not make the case different, rather it shows how that behavior should be downgraded. If in a similar case 2 matchdays are given, some criterion of uniformity has not worked. There is a flaw in the application of the sanction. What matters, to be evaluated, concerns the fact that with the ball in progress a non-violent gesture but aimed at liberation.
Pagliuca pulled an opponent's hair on a corner kick and was penalized, on appeal the penalty was revoked because Pagliuca's behavior was to remove the player from his area of competence to take the ball. Osimhen was waiting for a cross, he did not reach it and seeing himself prevented from participating in the action effectively pushed the opposing player without wanting to harm him or cause damage, just to contest the ball.
This is a completely less serious behavior than what was mentioned.
I would exclude conspiracy theories, there can be an error but it is important that it is corrected during the process. Once we have interpreted Mr. Aureliano's words we will act accordingly".
