Five convictions and one acquittal: this is how the first degree trial on the so-called "Capri system” born from an investigation by the Naples prosecutor's office (PM Henry John Woodcock, Celeste Carrano and Giuseppina Loreto) dating back to 2014 and relating to a ring of bribes and other benefits that would have been paid for the granting of permits relating to building practices on the blue island.
The defendants were put on trial on charges of various kinds, including extortion, corruption and unauthorized intrusion into a computer system. The first criminal section of the Court of Naples (college A, presided over by judge Maurizio Conte and composed of associate judges Federico Somma, Antonia Napolitano Tafuri) has acquitted the design engineer Gennaro DellaRocca.
It has instead condemned the official of the municipal technical office of Capri Mario Cacciapuoti to 5 years of imprisonment; Cyrus Of Capua, believed to be the one who contacted the victims, to 3 years in prison; the lieutenant of the Carabinieri and former commander of the Capri station Michele Sansonnand 5 years of imprisonment; the entrepreneur of the nautical sector Francesco Verardi to 2 years and 8 months of imprisonment and the Marshal of the Guardia di Finanza Pasquale Franco, at the time of the facts deputy commander of the Capri Tenancy, to one year of imprisonment (suspended sentence).
Cacciapuoti, Della Rocca and Di Capua were acquitted on several charges including criminal association. The judge also dismissed two charges against Franco, Sansonne and Verardi due to the statute of limitations.
Deputy Prosecutor Woodcock (now at the DDA but at the time of the facts in the section dealing with crimes against public administration), at the end of his closing speech, last September 28th requested the following sentences: for Cacciapuoti 7 years and 4 months of imprisonment; for Di Capua 6 years and 8 months; for Della Rocca 6 years; for Sansonne 4 years and 2 months; for Verardi 4 years and for Franco 2 years and 6 months.
