Ercolano, il Tar ha dato ragione ai cittadini: il lido La Favorita è stato condannato a rimuovere la costruzione che impediva l’accesso alla beach public.
New blitz by the deputy of Alleanza Verdi Sinistra, Francesco Emilio Borrelli, at the La Favorita beach in Ercolano, together with the civic committees. This follows the ruling of the TAR, N. 01769/2024 REG.PROV.CAU., issued on September 17, which rejected the appeal of the owners of the beach against the provision of the Municipality of Ercolano.
The Municipality had ordered the removal, within 15 days, of the portion of the structure located in the buffer zone of 5 meters from the shoreline. This decision allows free access to the public beach, as reported by Borrelli and the Hippocampus association.
“We were right on all fronts. The TAR said that we must proceed with the immediate demolition of at least 5 meters of the wooden construction built by Favorita beach which prevented citizens from having free access to the public beach for an entire summer season.
With the complicity of some 'professionals' who have lent themselves with every type of subterfuge and technical quibble to ensure that this injustice continues over time. An act of unspeakable arrogance and wickedness against which we will continue to fight to prevent this disgrace from happening again in the next bathing season.
The citizens of Ercolano have been defrauded of their right to access the beach without having to ask anyone's permission and despite the TAR order the free beach remains inaccessible via the shoreline.
I ask the mayor of Ercolano to take part in the management to follow up on what the Court ordered in the absence of activity by those who should respect the law and do not. Let the bulldozers come and follow up on what the Court ordered”. This is Borrelli's harsh comment.
